Being cagey about your startup idea is generally sound advice; after all you don't want others to benefit from your idea at your expense. However there is one situation when being cagey could be counter productive...when seeking guidance about protecting your IP. The following are the 3 reasons why I ask aspiring entrepreneurs seeking advice from me to tell me as much as possible about their startup idea. #1. If you withhold information, the advice you are given may well be inaccurate; this is probably the most important reason to bear in mind. #2. It does not make for a conducive working relationship (I can usually spot a mile off when a client is being deliberately vague about their business idea!). #3. If you are seeking IP advice from someone in a position of trust (e.g. a professional legal/business advisor) then a duty of confidentiality usually crystallises over your discussions which the advisor is bound by). So feel free to be open and transparent...after all your IP advisor may well be able to tell you whether your idea is the 'ace up your sleeve' that you thought it was!

As an aspiring entrepreneur money is tight. So make the most of any meeting you have with an IP professional by asking the following 3 questions! #1. Is my business idea protectable? If so how? #2. Given that my budget is limited, is there any way I can protect my business idea without spending £1000s on various intellectual property rights? #3. If you were in my position, what should I focus on next in terms of developing my idea? The great thing about these questions is that they are open-ended and therefore facilitate a productive discussion about your startup idea with someone presumably who has experience of advising people in circumstances similar to yours. For me, question #2 is perhaps the most crucial for you. Why? Well the conventional methods of protecting IP (e.g. trade marks and patents) may well be cost prohibitive and time consuming for you to pursue as a startup. The first photo is of British inventor, Richard Browning demonstrating his latest invention, an Iron-Man-style flight suit at the Ted (Technology, Entertainment and Design) Conference in Vancouver recently. For many inventors and aspiring entrepreneurs developing an idea into a viable product usually takes years and years of trial and error; and for some, one reward for all this hard work is the chance to secure a patent for their invention. The benefits of a patent are essentially two-fold; one to prevent others from simply copying the invention and two, for the inventor to commercialise it. So what does an inventor have to do to secure a patent? Well in the UK, his patent application to the Intellectual Property Office (IPO) must satisfy the following criterion. The invention must: 1. BE NOVEL (NEW). In other words it must never have been made public by anyone, in any way, anywhere in the world, before the date on which an application for a patent is filed. 2. INVOLVE AN INVENTIVE STEP (NOT OBVIOUS). Or to put it another way, when compared to what is already known, the invention would not be immediately obvious to a skilled practitioner in the relevant technical field. 3. BE CAPABLE OF INDUSTRIAL APPLICATION. This means that the invention must be able to be put to some use. 4. NOT FALL INTO THE EXCLUDED CATEGORY FOR NON PATENTABLE MATTER; in other words a patent cannot be granted for certain types of invention such as a discovery, a scientific theory or mathematical method. When most people think of intellectual property they typically cite 'trade marks, patents and copyright.' However 'trade secrets' are also a major form of intellectual property. For many companies, their trade secrets and importantly ensuring they don't get into the hands of their competitors can mean the difference between the companies staying in business or going bust. This explains why Waymo (a company spun-out from Google's self-driving division) will be in court today accusing Uber of using its self driving technology without its consent to develop its own driverless cars. Waymo are claiming that a former employee downloaded 14,000 confidential documents relating to this technology in order to establish a rival company which was then bought by Uber. It will be interesting to see whether Waymo are successful!
